Welcome to Kiss and Makeup. These Terms of Service ("Terms") govern your use of our website kissandmakeup.co.nz ("Site") and any orders you place with us. By using the Site or placing an order, you agree to these Terms.
1. About Us
Kiss and Makeup is a New Zealand-owned beauty retailer operating online at kissandmakeup.co.nz and from our physical store at 7 Camp Street, Trentham, Upper Hutt 5018. You can contact us at hello@kissandmakeup.co.nz or 027 471 5002.
2. Acceptance of Terms
By browsing, placing an order, or creating an account on the Site, you confirm that you:
Are at least 18 years old, or have the permission of a parent or guardian
Accept these Terms and our Privacy Policy
Agree to our Courier and Returns policy at kissandmakeup.co.nz/courier-returns/
We may update these Terms from time to time. Continued use of the Site after changes means you accept the updated Terms.
3. Your Account
You can place orders as a guest or by creating an account. If you create an account, you are responsible for keeping your login details secure. Let us know straight away if you suspect unauthorised use.
4. Placing an Order
When you place an order you are making an offer to buy the listed products at the listed price. Your order is accepted when we send you an order confirmation email.
If we cannot fulfil your order (for example, items out of stock, a pricing error, or a payment issue), we will let you know and refund any payment.
We reserve the right to refuse or cancel orders at our discretion — for example, where we reasonably suspect fraudulent activity, unauthorised resale (see Section 12), or an obvious pricing error.
5. Prices and Payment
All prices are in New Zealand Dollars (NZD) and include GST where applicable.
We accept the payment methods listed at checkout (including credit and debit cards, Afterpay, and other options as displayed). Payment is taken at the time of order.
We do our best to keep pricing accurate. If a pricing error occurs we may cancel the affected order and refund you — we are not obliged to fulfil an order at an incorrectly listed price.
6. Shipping and Delivery
We ship across New Zealand via NZ Post CourierPost. Full delivery options, timeframes, and costs are on our Courier and Returns page at kissandmakeup.co.nz/courier-returns/.
You are responsible for providing an accurate shipping address and any delivery instructions the courier needs. If you provide an incorrect address and the parcel is lost or returned to sender, we may charge additional shipping to resend.
If you have a Rural Delivery address but select Urban Delivery at checkout, we will invoice you the $3 rural surcharge before dispatch.
7. Signature on Delivery and Parcel Theft
By default, we ship without signature. You can request Signature Required by typing it in the Order Comments field at checkout. We may also apply Signature Required at our discretion for high-value orders or in postcodes where we are aware of courier theft.
Important: NZ Post may contact you with the option to waive Signature Required when your parcel is out for delivery. If you accept the waiver, your parcel will be left without a signature and travels at your risk from that point.
Once NZ Post tracking confirms your parcel as delivered:
Responsibility for the parcel passes to you
We are not responsible for items that are lost or stolen from your property after confirmed delivery
We may require a Police Report to support any claim of theft after delivery
8. Returns, Exchanges and Refunds
Our full returns policy is on the Courier and Returns page at kissandmakeup.co.nz/courier-returns/. In summary:
Change-of-mind returns are accepted within 20 days of delivery, in original unopened condition. Shipping is non-refundable on change-of-mind returns.
Faulty or damaged products — please contact us straight away. We will arrange a replacement, repair, or refund consistent with your rights under the Consumer Guarantees Act 1993.
9. Product Accuracy and Allergies
We take care to describe products accurately and use supplier imagery where available. Colours, textures, and finishes may display slightly differently on your device than in person.
Cosmetics and skincare contain ingredients that may cause a reaction in some people. Please read the ingredient list on each product. If you have sensitive skin or known allergies, patch-test before use. If you are unsure whether a product is suitable for you, contact us before ordering.
We are not liable for individual reactions to products used as directed. If you have an adverse reaction, discontinue use and consult a pharmacist or GP.
10. Promotions, Discounts and Vouchers
From time to time we run promotions and offer discount vouchers and coupon codes. Unless stated otherwise:
Vouchers and codes are single-use per customer
Vouchers expire 90 days from issue unless explicity stated
Vouchers cannot be combined with other offers or used on already-discounted items
New-customer vouchers (for example, newsletter signup discounts) are limited to one per household and first order only
We reserve the right to cancel a voucher where we reasonably suspect misuse, fraud, or resale
11. Competitions and Prize Draws
Competitions we run on our social channels and newsletter are:
Open to New Zealand residents only
Open to entrants aged 18 or over
Subject to the specific terms stated in the competition post
Prizes are non-transferable and no cash alternative is offered. Winners will be notified by email or direct message within 7 days of the draw.
12. Trade, Retail and Bulk Purchases
Kiss and Makeup products are sold for personal, non-commercial use. We do not supply products for resale through other retail channels without prior written approval from our directors.
If you wish to purchase for resale, to stock another store, or in bulk quantities beyond ordinary personal use, contact us at stephen@kissandmakeup.co.nz before ordering. We reserve the right to cancel orders we reasonably believe are placed for unauthorised resale.
13. Intellectual Property
All content on the Site — including text, photography, logos, and trade marks — is owned by or licensed to Kiss and Makeup and is protected under New Zealand and international copyright and trade mark law. You may not copy, reproduce, or use our content for commercial purposes without our written permission.
14. Your Use of the Site
You agree not to use the Site:
For any unlawful purpose
To harass, abuse, or harm others
To transmit viruses, malware, or other harmful code
To attempt to gain unauthorised access to our systems, accounts, or data
To scrape, reproduce, or republish our content for commercial gain
We may suspend or cancel accounts and refuse orders where these Terms are breached.
15. Privacy
Any personal information you provide is handled in accordance with the Privacy Act 2020 and our Privacy Policy at kissandmakeup.co.nz/privacy-policy/.
16. Consumer Guarantees and Your Statutory Rights
If you are a consumer, you have statutory rights under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986. Nothing in these Terms limits your rights under those Acts.
If you are buying for business purposes (for example, resale, stocking a clinic, or trade supply), the Consumer Guarantees Act does not apply and the parties agree to contract out of it to the fullest extent permitted.
17. Our Liability
Subject to your rights under Section 16, and to the maximum extent permitted by law:
We are not liable for indirect or consequential losses (for example, loss of profit, loss of opportunity)
Our total liability in connection with any order is limited to the price paid for that order
We are not liable for delivery failures or delays caused by NZ Post, CourierPost, or any third-party courier
18. Events Beyond Our Control
We are not liable for delays or failures caused by events outside our reasonable control — including courier disruptions, power or internet outages, extreme weather, industrial action, pandemic-related restrictions, or supply-chain disruptions affecting our suppliers.
19. Changes to These Terms
We may update these Terms from time to time. The current version is always available at kissandmakeup.co.nz/terms-of-service/ with the "Last updated" date at the top. Continued use of the Site after an update means you accept the updated Terms.
20. Governing Law and Disputes
These Terms are governed by New Zealand law. If you have a concern, please contact us first at hello@kissandmakeup.co.nz — most issues can be resolved quickly this way. If we cannot resolve a concern between us, either party may refer the matter to the Disputes Tribunal of New Zealand or a Court of competent jurisdiction in New Zealand.
