This website is operated by K&MU Limited (trading as Kiss and Makeup™. Throughout the site, the terms “we”, “us” and “our” refer to Kiss and Makeup™. Kiss and Makeup™ offers this website, including all information, tools, services, products and special offers available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, notices and offers stated here.
By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. Our store is hosted on BigCommerce. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are 18 years or older.
You may not use our products for any illegal or unauthorised purpose nor may you, in the use of the Service, violate any laws in New Zealand (including but not limited to copyright laws).

PLEASE NOTE: If you are a Retailer looking to on-sell products purchased from Kiss and Makeup (whether purchased directly on this website or via 3rd party platforms such as Trademe or The Market), you must contact our Head Office in the first instance for approval by the Directors (Stephen Beath or Sabrina Baker) - primarily to ensure we have sufficient stock as our inventory is generally limited). We do not offer wholesale pricing as our focus is primarily on servicing the needs of New Zealand consumers directly. We reserve the right to cancel any order without explanation.
SECTION 2 - GENERAL CONDITIONS
We reserve the right to refuse service to anyone for any reason at any time.
You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.
We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate.
We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.
You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

Product Reviews
We may out our sole discretion publish product reviews left by customers who have shopped with us. We will not publish any review where a persons name is not used. We will also not publish any review where a product is likely deemed faulty as that is not often representative of the commonly found traits of that product. For instance, if you purchase a product from us that has a defect, we are entitled to make good by either sending a non defective product to you. If the product has a systemic fault, we'll withdraw it from our site as soon as our supplier confirms defect is systemic. You agree to indemnify, defend and hold harmless K&MU Limited (Kiss and Makeup™) and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).
SECTION 17 - ENTIRE AGREEMENT
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

SECTION 21 - DELIVERY INFORMATION PROVIDED WITH YOUR ORDER
You must provide sufficient courier delivery information that is readily understandable by Kiss and Makeup or CourierPost. If we think the address may not be sufficient for our couriers to deliver the order safely and/or to a location that is easily found, we may seek further clarification or an alternative address. We may ask for an address that has someone at site able to sign for acceptance. If we do not hear from you when clarifying an address we will either not fulfil the order (and provide a full refund) or simply wait to hear from you. You may need to check your spam or junk folder if the email from us is not in your inbox.
SECTION 22 - MISSING ORDERS/STOLEN PARCELS
If your parcel has been deemed delivered but you are not able to locate it, we will ask you to check with your neighbors as this is often the most likely reason your parcel has not been located. Once you have checked with your neighbours and the parcel is still missing, we will contact NZ Post to ask for an investigation to be commenced. Usually it takes between 1 to 2 business days for the GPS location to be checked and the driver spoken too.
If your parcel is deemed to be stolen (i.e. the GPS location is showing your parcel to be delivered to your address) we will ask for you to get a Police Report before we replace your parcel. This is to reduce the possibility of future offences and reduce costs for everyone involved.
SECTION 22 - SPECIAL OFFERS, DISCOUNT/COUPON CODES, PRIZE DRAWS

All Prize Draws
All prize draws are open to NZ Residents only and for people aged 18 and over. Unless otherwise specified the prize draws winner(s) are selected at random by Kiss and Makeup. We regularly run social media competitions where we ask people to leave a comment on a particular post (usually this is the Kiss and Makeup Instagram page), and entries will only be valid on the specified post even if the post appears on other platforms. The Winners name will be published on social media. The prize must be redeemed within 60 days of receiving the winning notification. The prize cannot be exchanged for cash (and no change given for vouchers partially used). The terms of the prize draw can be changed without notice at any time.
Vouchers/Coupon Codes Terms and Conditions
All vouchers and coupon codes can only be used once per customer, will expire within 90 days or the date printed on the offer (whichever is sooner), and can't be used in conjunction with any other offer (unless explicitly stated). All vouchers/coupon codes cannot be used by Retailers and we will automatically cancel the order if we believe this to be the case. We encourage all Retailers to contact our Head Office in the first instance before attempting any purchase.
If you receive a voucher (including either the 10% Off voucher) for signing up to our newsletter this only applies for new customers only for your first purchase with Kiss and Makeup. If we deem that you are abusing the offer (such as having ordered from us before we will cancel your order.Limited to NZ residents only (i.e. we will not ship to other countries outside of NZ).
Write a Google Review... Get a $5 Voucher Ts and Cs
Sometimes we will ask you to do a Google Review and as a token of our appreciation we will give you a $5 voucher code to use on our website www.kissandmakeup.co.nz . The voucher can't be used in conjunction with any other offer and will expire within 60 days of being issued (or sooner if stated). You can only do one Google Review. The voucher is not transferable and can be used on any product at www.kissandmakeup.co.nz including anything in our sale or clearance categories.
Kiss and Makeup $5 Voucher Ts and Cs
If you receive a $5 Voucher the terms are as follows: Single use only, one voucher per person, can't be used in conjunction with any other offer such as promotional discount, can't be transferred to another person or exchanged for cash. No change given. Expires within 2 months of receiving the voucher (or earlier if stated on the voucher).
